DOI Tells West Flagler To Take Its Case To State Court

The U.S. Department of the Interior responded to a motion last Monday from West Flagler and Associates in a court case that could determine the future of legal sports betting in Florida.

In the DOI’s filing, which appeared on the docket at 4:52 p.m. ET, the agency requests that the U.S. District Court of Appeals for the District of Columbia Circuit allow its June 30 decision to stand, which ultimately would clear the way for the Seminole Tribe to launch its Hard Rock Bet platform in Florida.

A decision from the court is not imminent, as West Flagler has seven days, or until Oct. 2, to respond. From there, the U.S. Court of Appeals for the District of Columbia Circuit would begin to consider the motion, but there is no specific timeline for the court to issue a decision.

In its Monday filing, DOI attorneys wrote that “a stay is not warranted, because any such petition could present no substantial question for the Supreme Court to review.”
